Terms of use

1. Acceptance

These terms form a contract between you and Audrey Lalonde, who operates PsyPsy ("PsyPsy", "we"), established at 14, rue de Falaise, Blainville (Québec) J7B 1X6.

2. Who can use PsyPsy

• You must be of full age and reside in Québec.
• An account is personal. You do not share it.
• You undertake to provide accurate information and keep it up to date.
• A clinic account is created by a person authorized to represent that clinic.

3. What PsyPsy is — and is not

PsyPsy is a matching service. We help you find a verified mental health professional who has availability.

PsyPsy is not:

• a care, health or psychotherapy service;
• an emergency or crisis service;
• a service that makes diagnoses, gives clinical opinions or recommends treatment;
• a party to the professional relationship formed between you and the professional.

The professional you meet practises under their own professional responsibility, under the rules of their order. Their fees, availability, methods, cancellation policy and the quality of their services are theirs, not ours.

4. Verification of professionals

Before a professional can contact anyone, we verify their licence and their membership in their professional order. An approved profile is locked: any change to qualifications goes back through our validation.

What this verification means: at the time of verification, the person was indeed listed on their order's roll.

What it does not mean: we guarantee neither competence, nor service quality, nor the suitability of a given professional to your situation, nor the continued maintenance of their registration between verifications. You remain free — and encouraged — to check a professional's registration yourself with their order, whose roll is public.

If you find that a professional is no longer in good standing or behaves inappropriately, write to us at info@psypsy.ca. Ethics complaints, however, fall to their order.

5. How the service works

For people looking for a professional

• Your request is presented anonymized to relevant professionals.
• It stays active for 30 days, extendable.
• A professional may offer you up to three time slots; you accept or decline each one.
• Your identity is revealed only with your explicit consent, professional by professional.
• You can withdraw your request or mark it fulfilled at any time.
• A professional may withdraw from an already accepted appointment. We inform you; your request then returns to the list.

For professionals and clinics

• Your qualifications must be accurate and up to date.
• You contact a person only through the platform, and only in the context of a request you are answering.
• You neither keep nor use the information in a request for any purpose other than answering it.
• You comply with the professional obligations of your order, which prevail over these terms.
• A clinic acts on a professional's behalf only with that professional's consent, which they may withdraw.

6. Pricing

• Professionals and clinics: use of the platform is free, and will stay free.
• People looking for a professional: free for a limited period from launch. Any future pricing would be announced in advance and would never apply retroactively.
• The professional's fees do not pass through PsyPsy: they are settled directly between you and them.

7. What you undertake not to do

• Impersonate someone else, or present yourself as a professional without being one.
• Submit a fraudulent request, or submit on someone's behalf without their authorization.
• Use the platform for solicitation, advertising or recruitment.
• Extract, copy or scrape platform data by any automated means.
• Attempt to circumvent security measures or access information not meant for you.
• Engage in harassing, hateful, discriminatory or threatening speech.
• Use the platform for unlawful purposes.

We may suspend or close an account that breaches these rules, with immediate effect if someone's safety is at stake.

8. Content you post

You keep your rights over what you write. You grant us the limited licence needed to host it and display it to the people concerned, solely to operate the service. You are responsible for what you write, including in the free-text description of your request.

9. Limitation of liability

To the extent permitted by law:

• We do not guarantee that a professional will answer your request, nor how quickly.
• We are not responsible for the acts, omissions, advice or services of a professional met through the platform.
• We are not responsible for the outcome of any step taken with a professional.
• We do not guarantee uninterrupted or error-free operation, and we endeavour to fix promptly what does not work.

These limits set aside nothing that Québec law, in particular consumer protection law, makes impossible to set aside.

10. Suspension and closure

By you: at any time, from your account. See the privacy policy for what happens to your information.

By us: in the event of a breach of these terms, a risk to someone's safety, or if a professional ceases to be registered with their order. Except in an emergency, we inform you and give you the opportunity to explain.

11. Intellectual property

The PsyPsy name, the logo, the look of the site and its code belong to us. You do not reproduce them without written authorization.

12. Changes

We may amend these terms. Any significant change will be signalled to you at least 30 days in advance. Continuing to use the platform after it takes effect constitutes acceptance.

13. Governing law

These terms are governed by the law applicable in Québec. Any dispute falls to the competent courts of Québec.
